These Terms and Conditions are the standard terms for the sale of goods by Petit Miracle Interiors Ltd, company limited by guarantee, registered in England under number, 06812087 whose main trading address is West12 Shopping Centre, London, W12 8PP
1. Definitions and Interpretation
1.1 In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:
means, any day other than a Saturday, Sunday or bank holiday;
means any day of the year;
means a delivery of Goods, the character and/or value of which would be materially impaired if divided;
means the contract for the purchase and sale of Goods, as explained in Clause 3;
means the goods which are to be supplied by Us to you as specified in your Order (and confirmed in Our Order Acceptance);
means a calendar month;
means the price payable for the Goods;
means a special offer price payable for Goods which We may offer from time to time;
means your order for the Goods [as attached] OR [as shown overleaf];
means Our acceptance and confirmation of your Order as described in Clause 3;
means Petit Miracle Interiors, a CLG, in England under number 10269679 whose main trading address is west12 Shopping Centre, London, W12 8PP.
1.2 Each reference in these Terms and Conditions to “writing” and any similar expression includes electronic communications whether sent by e-mail, [text message,] fax or other means.
2. The Contract
2.1 These Terms and Conditions govern the sale of goods by Us and will form the basis of the Contract between Us and you. Before making your Order, please ensure that you have read these Terms and Conditions carefully. If you are unsure about any part of these Terms and Conditions, please ask Us for clarification.
2.2 Nothing provided by Us including, but not limited to, sales and marketing literature, price lists and other documents constitutes a contractual offer capable of acceptance. Your Order constitutes a contractual offer that We may, at Our discretion, accept.
2.3 A legally binding contract between Us and you will be created upon Our acceptance of your Order, indicated by Our Order Confirmation and/or full payment of goods. Order Confirmations will be provided in writing.
2.4 We shall ensure that the following information is given or made available to you prior to the formation of the Contract between Us and you, save for where such information is already apparent from the context of the transaction:
2.4.1 The main characteristics of the Goods;
2.4.2 Our identity (set out above in Clause 2) and contact details (set out below in Clause 13);
2.4.3 The total Price for the Goods including taxes or, if the nature of the Goods is such that the Price cannot be calculated in advance, the manner in which it will be calculated;
2.4.4 Where applicable, all additional delivery charges or, where such charges cannot be calculated in advance, the manner in which they will be calculated;
2.4.5 Where applicable, the arrangements for payment, delivery and the time by which We undertake to deliver the Goods;
2.4.6 Our complaints handling policy;
2.4.7 We shall ensure that you are aware of Our legal duty to supply goods that are in conformity with the Contract;
2.4.8 Where applicable, details of after-sales services and commercial guarantees;
2.4.9 Where applicable, the functionality, including appropriate technical protection measures, of digital content.
3. Description and Specification of Goods
3.1 We have made every reasonable effort to ensure that the Goods conform to illustrations, photographs and descriptions provided in Our sales and marketing literature and descriptions provided by Our salespeople. We cannot, however, guarantee that all illustrations and/or photographs will be precisely accurate due to discrepancies that may arise during the printing process or differences in the colour reproduction of electronic displays.
3.2 If you receive any Goods that do not conform to illustrations, photographs or descriptions under sub-Clause 4.1 you may return those Goods to Us as provided in Clause 8.
3.3 We reserve the right to make any changes in the specification of the Goods that may be required to conform to any applicable safety or other legal or regulatory requirements without notice.
3.4 Bespoke Goods are available from Us. If you Order bespoke Goods from Us, We will produce or alter those Goods to your specifications and requirements. 3.5 When placing an Order for bespoke Goods, please ensure that all information that you provide to Us is correct, accurate and complete. We cannot accept the return of any bespoke Goods if the return is due to incorrect information provided by you. Please note that this does not affect your legal rights (including but not limited to those described in these terms and conditions).
4.1 If you indicate in your Order that you wish to collect the Goods from Us yourself you may do so after receiving Our Order Confirmation, during Our business hours of 11am-6pm Tuesday-Saturday.
4.2 You own the Goods once We have received payment in full for them.
5. Faulty, Damaged or Incorrect Goods
5.1 By law, We must provide goods that are of satisfactory quality, fit for purpose and as described at the time of purchase, in accordance with any pre-contract information We have provided, and that match any samples or models that you have seen or examined (unless We have made you aware of any differences. If any Goods you have purchased do not comply and, for example, have faults or are damaged when you receive them, or if you receive incorrect Goods, please contact Us as soon as reasonably possible to inform us of the fault, damage or error, and to arrange for a repair or replacement. Please note that if the Goods are incorrect as a result of your provision of incorrect information, rather than them not matching Our description, as explained in sub-Clause, you will not be able to return those Goods.
5.2 IF You have purchased your Goods on-line, beginning on the day that you receive the Goods (and ownership of them) you have a 14 Calendar Day right to reject the Goods and to receive a full refund if they do not conform as stated above. Alternatively, you may request a repair of the Goods or a replacement. We will bear any associated costs and will carry out the repair or replacement within a reasonable time and without significant inconvenience to you. In certain circumstances, where a repair or replacement is impossible or otherwise disproportionate, We may instead offer you a full refund. If you request a repair or replacement during the 14 Calendar Day rejection period, that period will be suspended while We carry out the repair or replacement and will resume on the day that you receive the replacement or repaired Goods. If less than 7 Calendar Days remain out of the original period, it will be extended to 7 Calendar Days
5.3 Please note that you will not be eligible to claim under this Clause 6 if We informed you of any faults, damage or other problems with the Goods before your purchase of the them; if you have purchased the Goods for an unsuitable purpose that is neither obvious nor made known to Us and the problem has resulted from your use of the Goods for that purpose; or if the problem is the result of normal wear and tear, misuse or intentional or careless damage. Please also note that you may not return Goods to Us under this Clause 8 merely because you have changed your mind. Please refer to Clause 9 for details of what to do if you change your mind.
5.4 To return Goods to Us for any reason under this Clause 6, you may do so in person during Our business hours of 11am-6pm Tuesday-Saturday or you may return them to Us by post or another suitable delivery choice
5.5 Refunds (whether full or partial, including reductions in price) under this Clause 6 will be issued within 14 Calendar Days of the day on which We agree that you are entitled to the refund.
5.6 For full details of your rights and remedies as a consumer, please contact your local Citizens Advice Bureau or Trading Standards Office.
6. Returning Goods If You Change Your Mind
6.1 If you are not satisfied with any (non-bespoke) Goods purchased from Us you have the right to return them for a full refund for 3 working days after the purchase date, if the item has not left our premises. After this time, you will be offered an exchange or store credit, subject to the provisions of this Clause 7, if done so within 14 days of the sale date. Store credit is valid for 6 months after issue date.
6.2 This Clause 7 does not apply to bespoke Goods. Goods which We have produced or altered to order for you cannot be returned if you change your mind.
6.3 You may return Goods to Us in person during Our business hours of 11am-6pm Tuesday-Saturday or you may return them by responsible and reliable delivery service of your choice. You are solely responsible for the cost of returning Goods to Us under this Clause 8. We cannot be held responsible for any damage incurred during transport of the returned item.
7.1 For Goods that We have produced, customised or altered (including bespoke Goods), We guarantee that for a period of 12 weeks from the date of delivery, the Goods will be free from material defects. This guarantee is subject to the exceptions listed in sub-Clause 8.2.
7.2 Our guarantee does not apply to any defects in the Goods caused by:
7.2.1 Normal wear and tear;
7.2.2 Deliberate damage and/or misuse of the Goods;
7.2.3 Accidental damage;
7.2.4 Failure to use the Goods in accordance with their instructions; or
7.2.5 The alteration or repair of the Goods by you or any third party that is not authorised by Us.
7.3 Our guarantee exists in addition to your legal rights as a consumer. More information on your rights as a consumer can be obtained from your local Citizens Advice Bureau or Trading Standards Office.
8. Our Liability
8.1 We will be responsible for any foreseeable loss or damage that you may suffer as a result of Our breach of these Terms and Conditions or as a result of Our negligence (including that of Our employees, agents or sub-contractors). Loss or damage is foreseeable if it is an obvious consequence of Our breach or negligence or if it is contemplated by you and Us when the Contract is created. We will not be responsible for any loss or damage that is not foreseeable or any damage that you have been made aware of at the time of or before the sale.
8.2 Nothing in these Terms and Conditions seeks to exclude or limit Your legal rights as a consumer. For more details of Your legal rights, please refer to Your local Citizens Advice Bureau or Trading Standards Office

10. Complaints and Feedback
10.1 We always welcome feedback from Our customers and, whilst We always use all reasonable endeavours to ensure that your experience as a customer of Ours is a positive one, We nevertheless want to hear from you if you have any cause for complaint.
10.2 All complaints are handled in accordance with Our complaints handling policy and procedure, available from staff members in person or via email at firstname.lastname@example.org.

11. Other Important Terms
11.1 We may transfer (assign) Our obligations and rights under these Terms and Conditions (and under the Contract, as applicable) to a third party (this may happen, for example, if We sell Our business). If this occurs you will be informed by Us in writing. Your rights under these Terms and Conditions will not be affected and Our obligations under these Terms will be transferred to the third party who will remain bound by them.
11.2 You may transfer (assign) the benefit of the guarantee in Clause 7 to any person who purchases the Goods from you after you have completed purchasing the Goods from Us.
11.3 You may not transfer (assign) your obligations and rights under these Terms and Conditions (and under the Contract, as applicable) without Our express written permission.
11.4 If any of the provisions of these Terms and Conditions are found to be No failure or delay by Us in exercising any of Our rights under these Terms and Conditions means that We have waived that right, and no waiver by Us of a breach of any provision of these Terms and Conditions means that We will waive any subsequent breach of the same or any other provision.
12. Governing Law and Jurisdiction
12.1 These Terms and Conditions, the Contract, and the relationship between you and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with English law.Any dispute, controversy, proceedings or claim between you and Us relating to these Terms and Conditions, the Contract, or the relationship between you and Us (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.
Refund policy for items purchased on-line/website purchases
Consumer Contracts Regulations
Under the Consumer Contracts Regulations, your right to cancel an order starts the moment you place your order and ends 14 days from the day you receive your goods. This 14 day period is the time you have to decide whether to cancel, you then have a further 14 days to actually send the goods back.
Notification of the cancellation must be received in writing within 14 working days; starting from the day after the goods are received. These regulations dictate that we will refund the cost of the item(s) ordered and, in addition to this, the original despatch charge. Petit Miracles is not liable to cover costs of returning the goods.
*Please note this only applies to customers located within the European Union.
Where goods are simply unwanted and notification is received after the 14 day cooling off period, we will be delighted to offer an exchange or a gift card to the value of the goods within 14 days of you receiving the goods. Petit Miracles is not responsible for covering costs of returning the goods.
In this instance, please notify us of your intent to return the goods in writing, or by email to info@ petitmiracles.org.uk. Items must be unused and in the same condition as they were delivered to you, accompanied by a valid order reference. Once the 14 day period has passed we have the right to refuse exchanges of any unwanted items. Return delivery costs are the responsibility of the purchaser. Within London, £15-50 and outside London the return delivery charge will be the same as charged in original delivery quote.

Faulty/ Damaged Goods
If for any reason the goods you receive are faulty or damaged in any way other than described on our website, we will be happy to exchange the items or offer a full refund. Please contact info@ petitmiracles.org.uk. The damaged product will be replaced with the same item as soon as possible. An alternative product will be offered in cases where stocks are no longer available.
Should a replacement not be required please notify us and we will refund the cost of the damaged products. Please note that it may be necessary to provide photographic evidence of the damaged goods, we ask for your flexibility so that the item can be collected by our driver.
Where goods are believed to be faulty, please notify us of your intent to return the goods in writing or by email: info@ petitmiracles.org.uk. All goods believed to be faulty will be required for Quality Review. Once this item(s) have been received, a Quality Review Investigation will take place within 10 working days to complete. Correspondence will be made directly with the customer.
The cost of returning all unwanted items are your responsibility, all returns should be securely packaged and sent to the following address:

If the original packaging has been disposed of or is no longer suitable, goods must be wrapped in appropriate packaging to ensure that the goods arrive with us in their original condition. We reserve the right to refuse a refund/ exchange for damages caused by insufficient packaging.
Where an order has qualified for a discount to be applied to a product this discount shall no longer apply if upon returning part of the order the resulting value is below the threshold for the discount to apply. The discounted products must therefore either be returned or they shall be charged at the full retail price.
Exchanges will be processed within 5 working days from the date the returned goods are received.
Where the goods have been received as a gift, items may be exchanged for alternative products or the amount can be applied to a gift card.
Where a refund is due, this will be processed onto the credit/ debit or gift card with which the purchase was made, within 2 working days from the date the returned goods are received. Refunds may take 5-7 working days to reflect against an account, depending on the bank.
Where the original purchase was made using a gift card and another form of payment; any refund owed will be credited to gift card in the first instance. If the total to be refunded is more than originally paid by gift card, any remaining refund balance will be refunded as a gift card.
- On items to be collected, once paid for, we can store an item for up to 10 days (unless another time is agreed). If not collected by this time, a storage fee of £10 a day will be charged to you, up to the price of the said item. After this, if still not collected item will be lost.
- If you are having your item delivered, please note that it is your responsibility to ensure the item will fit. Not only in the space you have decided to place it, but also the navigation to the such place, e.g. stair wells, lifts, front doors. If the item does not fit, you will be charged an additional fee (minimum £35 for local delivery) to return the item back to our store.
- If you would like to change the date/cancel a delivery we must be notified at least 48 hours before scheduled delivery. Please note we are closed on Sunday and Monday so these days are not included in this.
